Booger provides institutional-style market data visualization, analytics, and research tooling. You are purchasing software access and data analysis features, not trading signals, brokerage services, portfolio management, or fiduciary advice.
Booger content is for informational and educational purposes only. Nothing on the platform is investment, legal, tax, or accounting advice. Booger does not provide personalized recommendations and does not evaluate suitability for your financial situation. You are solely responsible for your own trading and investment decisions.
Trading and investing involve substantial risk, including possible loss of principal. Derivatives and leveraged products may increase risk. Past performance does not guarantee future results. Historical patterns, model outputs, and backtests may not predict future outcomes.
You must be legally able to enter a binding contract and comply with applicable laws in your jurisdiction. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Access is subscription-based and non-transferable. Pricing, renewals, and payment processing are handled through Stripe. Feature access is tier-based: Scout includes SPY access, while Command includes all supported tickers and any Command-only additions. Changes, upgrades, downgrades, and cancellations are managed through your billing portal and may take effect on the next billing cycle unless otherwise stated.
You may not reverse engineer, scrape at abusive rates, interfere with service availability, share account access, or use the platform for unlawful activity. We may suspend or terminate accounts for abuse, fraud, or violations of these Terms.
Booger and its content, software, and branding are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the service for your internal, lawful use during an active subscription.
We may update, modify, or discontinue features at any time. We do not guarantee uninterrupted availability, error-free operation, or that any model output will be complete, current, or suitable for your objectives.
Market data, charting, alerts, and analytics may be delayed, incomplete, or inaccurate due to exchange feeds, third-party APIs, network outages, software bugs, or service interruptions. You acknowledge these risks and agree that Booger is not liable for trading or investment losses arising from delayed, missing, or incorrect data.
If you connect third-party brokerage or execution services, those services are external and outside Booger's control. Booger is not responsible for execution failures, rejected orders, slippage, partial fills, outages, API changes, revoked credentials, or unauthorized trades resulting from compromised keys or account credentials.
To the maximum extent permitted by law, Booger and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for trading losses, lost profits, lost data, or missed opportunities arising from your use of the platform.
You agree to defend, indemnify, and hold harmless Booger and its operators from and against any claims, liabilities, losses, damages, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of your misuse of the platform, violation of these Terms, violation of law, or infringement of third-party rights, including claims related to market manipulation or regulatory investigations.
To the fullest extent permitted by law, disputes will be resolved by final and binding individual arbitration, not in court, under the Federal Arbitration Act and applicable arbitration rules. You and Booger each waive any right to a jury trial and any right to participate in class, collective, consolidated, or representative actions. Claims that qualify for small claims court may be brought there on an individual basis.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Arkansas.
